Making falses documentation in criminal cases and then trying to give bribery to cover their wrongdoings, is the disgusting practice of the current Vietnamese investigative police. An inside source told us so.
For a long time, people often think that only accused make falsification to get lighter consequences. However, that is only the surface. The truth inside is much more terrifying.
Currently, someone tells us that the Communist Police do their criminal investigation very arbitrarily, just to complete their tasks, to get promotion, regardless of whether they are wrong or not. When the matter is in danger of being exposed, they are one step ahead. They use the money to bribe court and the prosecutor’s office to accept their false investigation results even though the investigation record has many holes. That is the way to cover up the crimes of the investigating police. And this is also the reason why there are many unjust cases in the Vietnamese justice sector.
The Ho Duy Hai case is a typical example for this case. The procedural apparatus of the Communist government, from the local to the central, all conspired with each other, singing the same song, despite the fact that the evidence was tenuous.
Starting with the Long An Provincial Police, it was the police officers doing this investigation that intentionally distorted the case file and fabricated evidence. This is considered a case of falsification, that is, posing as the accused guilty while the evidence does not prove it.
Making false documentation has many causes. It may be due to poor professionalism, it may be due to being bribed by the real perpetrator, etc. Usually, these false documentations will be covered up and the court will wrongly convict the accused.
However, “walking at night has a day to meet ghosts”, the phenomenon of making a false case and then their wrongdoing is detected one day. Like the case of Ho Duy Hai, both social networks and the press got involved, exposing everything that making false documentation is exposed to the public. To cover this up, the fraudsters will spend money to bribe court and procuracy officials, so that the court and the prosecutor’s office must decisively crush the defendant’s resistance.
In a criminal case, the lawyer is the mediator. In the case of Ho Duy Hai, this defendant experienced many defense lawyers, including a lawyer who accepted the defense, but during the investigation and in the first instance session, there were signs of cooperating with the Long An police to make a false documentation to force Ho Duy Hai to die. In addition to the lawyer, all three procedural agencies know each other. They easily exchanged money to make the case according to their will.
The Ho Duy Hai case was wrong from the beginning, however, if the court ruled that there was not enough basis to convict Ho Duy Hai, it would mean that the Long An Police made a false case. Therefore, if they throw a javelin, they have to follow it, Long An police bribed the Court and the Procuracy in the two first-instance and appeal hearings.
After these two trials, the case was still opposed by social networks. Finally, the case is brought to the highest level, i.e. the Cassation. If the cassation officer determines that there are not enough grounds to convict Ho Duy Hai, those who make false documentations and falsely accused him may lose their positions, even risk being probed. And so, the group forced Ho Duy Hai to die in two first-instance and appeal hearings, and continued to bribe those taking part in the cassation court. And that is why the whole government apparatus decided to force Ho Duy Hai to death.The case of Nguyen Van Chuong is similar to Ho Duy Hai. This case was falsely accused by Duong Tu Trong and Do Huu Ca, and since then, both the Court and the Procuracy of the same level have coerced Nguyen Van Chuong.
Nguyen Van Chuong and Ho Duy Hai are just cases known to society, there are many other cases where the victim was unjustly wronged but there was no way for them to complain, then executed, and so the case ended. That’s the scary thing about the Communist proceedings. Justice is absent, injustice is rampant.
