Lawyer and journalist Le Quoc Quan, a former student of detained Luu Binh Nhuong, when he was a student at Hanoi Law University, said in an article published on VOA’s website on November 17:
“Recently, I heard from a friend who is working in the Government that, on one occasion 3 years ago, Truong Hoa Binh said about lecturer Luu Binh Nhuong: ‘That guy is crying for others, just wait!”
That is completely well-founded, if based on the article titled “Voice of representatives – necessary caution” published in the People’s Public Security newspaper on November 6, 2018, by Associate Professor, Dr. Do Canh Thin.
At the beginning of the article, the author raises the issue that:
“In addition to the vast majority of delegates who are enthusiastic and responsible and present convincing questioning content with a constructive spirit and attitude, there are still delegates who present untrue content, sometimes provocative…”
Obviously author Do Canh Thin did not name a specific name, but certainly, those who are interested in political news will immediately think of the name National Assembly member Luu Binh Nhuong.
According to the provisions of law, anyone who commits acts of “…posting untrue, sometimes provocative content…”, related to the internal affairs of the Communist Party of Vietnam, will be charged with the crime of “Opposing the Socialist Republic of Vietnam.”
This is a criminal offense stipulated in Article 117 of the Criminal Code.
After Luu Binh Nhuong was arrested, observers said that there was a high possibility that this was an act of revenge by judicial agencies, including the Ministry of Public Security and the People’s Courts. Because for many years when he was a 14th National Assembly member, Mr. Nhuong was the strongest critic of Minister To Lam’s Ministry of Public Security and Chief Justice Nguyen Hoa Binh’s People’s Court.
Specific evidence,
- Mr. Nhuong commented on the report of the Ministry of Public Security: “… I find the violations of the investigation agencies very terrible. The rate of not receiving denunciations is 94%; delay in sending decisions to the Procuracy 86%; Processing information after denunciation is 99.76% overdue,…”. This statement caused many police representatives to react violently, but Luu Binh Nhuong still reserved his opinion.
In 2020, when Nhuong questioned the Minister of Public Security, with a seemingly small matter, but embarrassed To Lam in the parliament, by saying:
“On holidays and New Year, the local police collect money from sellers…. I ask you to take any measures so that they don’t do this anymore…”
- With cases showing signs of injustice, such as the Ho Duy Hai case, the responsibility clearly belongs to Chief Justice Nguyen Hoa Binh. Mr. Nhuong commented:
“… public opinion believes that the decision of the Council of Judges of the Supreme People’s Court violated the principle of presumption of innocence, and was based on incriminating thinking and concepts ‘taboo’ in the criminal field. Although he acknowledged many key errors in the investigation process, he said that those errors ‘did not affect the nature of the case’.”
Mr. Nhuong stated his general opinion: The Supreme People’s Court’s Council of Judges did not consider the investigative agency’s procedural violations fairly, objectively, scientifically, and properly. It can be said that many hidden issues are covered up, such as the time the crime was committed, the time the victim died, violations in the seizure of fingerprints, blood samples, physical evidence…, especially the exclusion of other suspects in the case.
Nhuong also criticized Chief Justice Nguyen Hoa Binh saying: “… “there are no regulations allowing the Council of Judges of the Supreme People’s Court to rule on the appeal of the Supreme People’s Procuracy whether or not it is legal.”.
Public opinion evaluates that the focus is considered excessive on law enforcement agencies, to the point that a National Assembly Delegate from the Ministry of Public Security said in front of the National Assembly that “.. “Voters in the [Police] sector reacted angily to Mr. Nhuong’s statement.”
That is the source of why the former Chief Justice of the Supreme Court and former Permanent Deputy Prime Minister – Truong Hoa Binh – said about National Assembly Delegate Luu Binh Nhuong, “That guy is crying for others, just wait!”
And now, Mr. Luu Binh Nhuong, former Member of the 14th National Assembly, Deputy Head of the National Assembly’s People’s Petitions Committee, has been in detention.
But public opinion is concerned about how the responsibilities of those related to defendant Nhuong will be handled? There is a high possibility that this case will be a key case, related to the crime of “propaganda against the State.”
Among those involved, we must mention Chairman of the National Assembly Vuong Dinh Hue as a backer, and Vo Van Thuong as an accomplice, helping with “messages“.
