That is completely well-founded, if based on the article titled “Voice of representatives – necessary caution” published in the People’s Public Security newspaper on November 6, 2018, by Associate Professor, Dr. Do Canh Thin.
At the beginning of the article, the author raises the issue that:
“In addition to the vast majority of delegates who are enthusiastic and responsible and present convincing questioning content with a constructive spirit and attitude, there are still delegates who present untrue content, sometimes provocative…”
Obviously author Do Canh Thin did not name a specific name, but certainly, those who are interested in political news will immediately think of the name National Assembly member Luu Binh Nhuong.
According to the provisions of law, anyone who commits acts of “…posting untrue, sometimes provocative content…”, related to the internal affairs of the Communist Party of Vietnam, will be charged with the crime of “Opposing the Socialist Republic of Vietnam.”
This is a criminal offense stipulated in Article 117 of the Criminal Code.
After Luu Binh Nhuong was arrested, observers said that there was a high possibility that this was an act of revenge by judicial agencies, including the Ministry of Public Security and the People’s Courts. “… public opinion believes that the decision of the Council of Judges of the Supreme People’s Court violated the principle of presumption of innocence, and was based on incriminating thinking and concepts ‘taboo’ in the criminal field. Although he acknowledged many key errors in the investigation process, he said that those errors ‘did not affect the nature of the case’.”
Mr. Nhuong stated his general opinion: The Supreme People’s Court’s Council of Judges did not consider the investigative agency’s procedural violations fairly, objectively, scientifically, and properly. It can be said that many hidden issues are covered up, such as the time the crime was committed, the time the victim died, violations in the seizure of fingerprints, blood samples, physical evidence…, especially the exclusion of other suspects in the case.
Nhuong also criticized Chief Justice Nguyen Hoa Binh saying: “… “there are no regulations allowing the Council of Judges of the Supreme People’s Court to rule on the appeal of the Supreme People’s Procuracy whether or not it is legal.”.
Public opinion evaluates that the focus is considered excessive on law enforcement agencies, to the point that a National Assembly Delegate from the Ministry of Public Security said in front of the National Assembly that “.. “Voters in the [Police] sector reacted angily to Mr. Nhuong’s statement.”
